    2019—2020年)

    为全面落实中央、省、市关于优化营商环境的决策部署,加快打造国际化、市场化、法治化、便利化的一流营商环境,结合高新区实际,制定本行动方案。

    一、指导思想

    以习近平新时代中国特色社会主义思想为指导,全面贯彻落实党的十九大精神和习近平总书记对四川及成都工作系列重要指示精神,围绕高质量发展根本要求,坚持国际标准、市场公平、便捷高效、法治保障和改革创新五大原则,建立健全企业、项目、产业全生命周期服务体系,打造更优企业服务、更优产业生态、更优城市品质、更优政府治理,不断提高营商环境评价结果表现和企业满意度,为打造具有全球影响力的新经济策源地和活力区,加快建设国家高质量发展示范区和世界一流高科技园区提供战略支撑。

    二、工作目标

    2019年底,全面补短板强弱项,企业、项目、产业全生命周期服务体系初步形成,各领域营商环境便利度和企业满意度进一步提升,营商环境指标在全国高新区处于领先水平。到2020年底,智慧服务型数字政府总体建成,更优企业服务、更优产业生态、更优城市品质、更优政府治理成为普遍共识,“首证通”“创业天府·菁蓉汇”等创新品牌更加突出,营商环境指标在全国高新区成为标杆。

    三、高标准提供企业服务

    (一)企业开办8小时办好

    不断精简企业开办环节,探索实行营业执照与税务发票、公章一并发放,最终实现企业开办1个环节。将企业办照时间压缩到8个工作小时。深化企业开办“一网通办”“全域通办”“多点办照”,逐步开展企业办照24小时智能自助申报,实现100%企业登记事项能够通过自助端、手机端、电脑端办理,能够在各街道、产业功能区、银行营业网点办理。探索采用政府购买等方式,为辖区内新设立企业提供一套免费公章,争取逐步实现企业开办“零成本”。简化企业经营范围登记,探索建立企业住所(经营场所)清单管理,对清单内的住所(经营场所)注册登记时,免于提交住所使用证明。推广电子营业执照的应用,企业根据需要可随时自行下载使用。试行境外投资者“主体资格证明”承诺制,允许港澳台、外国投资者对提交公证认证复印件的真实性作出承诺后予以登记。(责任单位市场监管局,网络理政办、国际合作投服局、社会事业局、税务局、公安分局。逗号前为牵头单位,下同)

    (二)工程建设项目80日办结

    对工程建设项目审批制度实施全流程、全覆盖改革。实现立项用地规划许可、工程建设许可、施工许可、竣工验收每个阶段“一家牵头、并联审批、限时办结”。从立项到竣工验收涉及的行政许可、中介服务和市政公用服务总用时控制在80个工作日以内,其中部门行政审批时间控制在35个工作日以内,施工图审查等中介服务和水电气讯等市政公用服务控制在45个工作日以内,按照项目类别分梯度设置审批时限。全面实施企业投资项目承诺制,推进“先承诺后审批”管理模式。探索取消施工图审查环节或审查费用,降低企业制度性交易成本。优化工程建设项目并联验收机制,实行“多测合一”和“联合验收”。全面推行“区域评估”改革,统一编制区域性评估报告,评估结果区内项目共享使用。探索项目分类监管模式,对小型社会投资工程项目,探索投资项目备案和办理施工许可“一网通办”。实现建筑工程施工许可证网上申请、网上审批、限时办结、自行打证。实行设计人员终身负责制,开展建筑师负责制试点,推行全过程工程咨询服务,实施工程质量保险试点制度。(责任单位公园城市局,发展规划局、网络理政办)

    (三)用能便利度整体提升

    水电气讯报装业务实行政务大厅“一窗受理、限时办结”。进一步精简接入环节压缩办理时限。在市政自来水管网覆盖区域,获得用水耗时压缩至15个工作日(含委托供水企业施工耗时)或7个工作日(不含委托第三方施工耗时)。用电接入低压业务环节压缩为2个,无外线工程办理时间不超过2个工作日,有外线工程办理时间不超过7个工作日;高压业务环节压缩为4个,10千伏普通用户办理时间不超过21个工作日。集体居民用户燃气接入环节压缩到4个,办理时间不超过8个工作日;非居民用户燃气接入环节压缩到3个,办理总时长压缩到615个工作日。通讯接入环节压缩至3个,总时限不超过13个工作日。小微用户接入工程规划、路政、交警、绿化等相关审批,试行告知承诺管理。落实重大施工项目的政企磋商机制,进一步降接入时间、降配套费用、降用能成本。实现提前一个月公示水电气价格调整政策,确保调价信息公开透明。进一步提高用能稳定性和各类突发情况下的处理效率,减少非系统性的停供次数,缩短停供时间。(责任单位经济运行局,生态环境城管局、网络理政办)

    (四)不动产登记全面优化

    不动产一般登记业务的办理时限压减至4个工作日,其中土地首次登记3个工作日办结,抵押类登记1个工作日办结,注销登记、查封登记和异议登记即时办结。构建多层次、多维度不动产登记网上办事大厅,建立不动产“网上(掌上)登记中心”,实现不动产登记信息查询及部分业务办理24小时不打烊。积极推动不动产登记信息、电子档案与房屋交易信息实时互通共享,推动土地所有权登记与地籍地图测绘部门系统数据互联互通,探索实现不动产登记与水、电、气、网络、有线电视过户等关联业务联动办理。积极推进不动产登记电子证照服务。(责任单位公园城市局,网络理政办)

    (五)纳税服务全面提升

    推广网上申报、网上实名采集等智能办税措施,压减纳税人涉税资料1/4以上,实现80%以上涉税事项一次办结,力争纳税时间压缩至120小时。推广银联在线缴税方式,推广发票网上申领、认证、代开。全面贯彻国家各项减税降费政策,落实企业研发费用加计扣除等措施。对权限内的有关税费政策,在国家规定的幅度内降到法定税率最低水平。提升预约办税、电子退税、电子缴费、税务注销预检等服务。推广应用“税企掌上通”,通过“移动互联+人工智能”方式实现纳税服务的精准化、智能化、集成化。(责任单位税务局)

    (六)跨境贸易更加便利

    构建无缝对接航空和铁路口岸的大交通、大物流、大通关体系。创新开展定制服务、定期沟通、全时通关、全程指导的“两定两全”特色企业服务。深化“智慧海关”建设,开展先入区后报关、先出区后报关、提前申报、自报自缴、区间结转、分送集报等改革措施,压缩货物通关的外部作业时间60%以上,提高货物通关效率,降低企业物流成本。全面推行出口退税申报、证明办理、核准、退库等业务全程网上办理,实现电子退库全联网、全覆盖,对一二类出口企业开展无纸化申报管理,实现一类企业4个工作日办结、二类企业7个工作日办结。全面推广关税保证保险业务,实现先通关后交税,缩短通关时间;无需缴纳保证金,比银行保函费用更低,有效降低通关成本,减轻企业资金压力;比办理银行保函时间短,手续简单,办理更便捷;一份保单全国通用。实施跨境电商出口无票免征,开展出口退税无纸化申报,推行电子出口退税。(责任单位经济运行局,电子信息产业局、税务局)

    (七)优惠政策一窗通办

    在区级政务大厅设立涉企优惠政策办理事项专窗,及时梳理发布涉企优惠政策清单,建立以事项为基础的政策归类、发布、查询和受理机制,逐步实现涉企优惠政策相关事项“一口受理、一窗通办、一网查询”。提高企业对涉企优惠政策的知晓度和获得感。(责任单位经济运行局,网络理政办、各涉企优惠政策制定单位)

    (八)诉讼服务智慧高效

    全面推进诉源治理工作,坚持“宽准入严监管”原则,严格审查各类交易模式和交易结构创新中的合同效力。对一审买卖合同纠纷、借款合同纠纷、金融借款合同纠纷、承揽合同纠纷、委托合同纠纷的商事案件推行网上立案、跨域立案,以电子诉讼服务为核心,推动一网贯通全程多项业务的“智慧诉讼服务”新模式。继续深化“分调裁审”机制改革,有效推进案件繁简分流、轻重分离、快慢分道。积极采取措施缩短鉴定评估运转时间,完善鉴定评估案件跟进机制,鉴定评估从接收申请、通过审批、通知双方当事人、摇号确定评估鉴定机构到出具委托函,全部时长控制在7个工作日以内。加强行政审判工作,推进政府与法院联席会议常态化、行政诉讼司法白皮书、行政负责人出庭应诉“三项机制”落到实处。在自贸试验区内建立专业化国际商事案件审判组织。严控案件审理期限,平均审理天数缩短5天,民商事案件审限内结案率达100%。深化随案执行、即时履行,加快胜诉企业债权、胜诉市场主体权益实现,切实提高法院审判执行质效。(责任单位法院)

    (九)破产案件简易审理

    争创全省首家推行破产案件简易审理的基层法院,强化破产案件审判,缩短破产案件立案审查时间,实行破产案件“前台简案快审+后台难案精审”繁简分流模式。探索企业分类破产处置模式,推动完善破产重整、和解制度,促进有价值的危困企业走出困境。完善破产企业重整信用,企业信息重整后可申请在金融信用信息基础数据库中添加重整信息。降低破产成本,提高破产回收率,破产程序中债务人财产处置优先采用网络拍卖方式。完善破产管理人制度,引导具有工程技术、科学知识、企业管理经验等非中介人员参与管理,与破产管理人协会建立协调沟通机制。(责任单位法院,财政金融局、发展规划局)

    (十)简易注销扩大适用

    将简易注销适用范围扩大到领取营业执照后未开展经营活动、申请注销登记前未发生债权债务或已将债权债务清算完结的有限责任公司、非上市股份有限公司、非公司企业、农民专业合作社及其分支机构,将公告方式改为在国家企业信用信息公示系统上公告,公告时间由45天压缩至20天。对成都高新自贸试验区内,未办理过涉税事宜或办理过涉税事宜但未领用发票、无欠税及罚款的企业,将注销公告压缩至7天以内。对申请简易注销登记的各类企业,不再提交清算报告、投资人决议、清税证明、清算组备案证明等材料。建立企业简易注销容错纠错机制,经登记机关审查,存在“被列入企业经营异常名录”“股权被冻结、出质或者动产抵押”“企业所属的非法人分支机构未办注销登记”等不适用简易注销程序的,待异常状态解除后,允许企业再次依程序申请简易注销登记。对承诺书文字、形式填写不规范的企业,登记机关在企业补正后即受理其简易注销申请。对违背承诺或虚假承诺的,依法做出撤销注销登记等方式处理。(责任单位市场监管局,税务局)

    四、高质量供给产业要素

    (十一)构建具有全球竞争优势的产业生态圈

    按照“核心在产业、关键在功能、支撑在园区、机制是保障”的理念,强化功能区专业性生产和多样化生活功能,实现园区从单一生产功能向生产、服务、消费等多元功能转变。聚焦产业链关键环节和价值链高端环节,构建主题鲜明、要素可及、资源共享、协作协同、绿色循环的具有全球竞争优势的产业生态圈。围绕“芯屏端网”核心关键技术,培育、引进具有国际水平的电子信息产业开放实验室、研发中心、测试中心、技术转移中心,搭建共享平台和展示中心,打造新型产业社区和人才实训基地。围绕生物医药产业体系,建设药物研发、安全评价、临床评价等全链条创新服务平台,构建境内外生物医药健康领域保险衔接机制,提供不低于100亿元的专业保险额度。围绕新经济产业生态构建,加快建设新型基础设施,打造“一带一路”信息港、国家级互联网交换中心等重大基础设施,开展人工智能、物联网、无人驾驶等新经济试验区内审批和试验基地建设,推动5G在智能制造、智能网联汽车、环境监测等领域的建设和商用。(责任单位发展规划局,电子信息产业局、生物产业局、新经济局、空港新城管委会)

    (十二)递进梯度培育企业

    以促进企业成长为导向,编制高新发展“机会清单”定期向社会发布,为各类企业发展提供更多机会,以具体项目需要引导创新要素聚集到新经济领域和新产业赛道,让优质企业成长发展成为“城市合伙人”,让民营企业更多参与政府投资项目建设。根据企业所处发展阶段、行业领先水平、经济密度水平、经营增长潜力、自主创新能力等情况进行梯度递进培育,进一步激发企业创新活力。对首次认定的种子期雏鹰企业给予5万元一次性奖励;对首次认定的瞪羚企业给予1030万元一次性奖励;对首次认定的潜在独角兽企业、独角兽企业,分别给予30万元、100万元一次性奖励;对首次认定的平台生态型龙头企业给予200万元一次性奖励。支持初创企业成长为雏鹰企业,最高给予50万元一次性创业启动资金和房租补贴;支持瞪羚企业持续增长,给予连续被认定的瞪羚企业最高500万元奖励。(责任单位新经济局,科技人才局、发展规划局、公园城市局、财政金融局)

    (十三)打响“创业天府·菁蓉汇”双创服务品牌

    依托“创业天府·菁蓉汇”、中国—欧洲中心、中韩创新创业园、中国成都留学人员创业园,打造链接全球顶级科技园区和创新区域的国际化平台,构建“创业苗圃+孵化器+加速器+产业园”全链条孵化体系,推动建立“双创”孵化服务国际标准。打造“互联网+双创服务”产业孵化培育网络平台,实现线上信息发布、政策查询申报及受理、孵化载体信息管理、企业成长性评价等功能。对经认定的孵化平台,每年按照新增企业数量、入驻企业年度销售收入、获得专业股权投资融资额等进行综合评价,对5000平米(不含)以下的前十名,给予最高不超过300万元奖励;对5000平米以上的前五名,给予最高不超过500万元奖励。(责任单位科技人才局)

    (十四)推广“高新技术服务超市”

    推广“高新技术服务超市”模式,建设1个线上超市和“一核多园”的线下超市,整合研发设计、知识产权、技术转移、质量技术服务、创业孵化、人才服务、科技金融、政策咨询等高新技术服务业态,为企业提供自选式、便利化专业服务,促进从科技成果转化到新型创新组织的全链条高新技术服务系统集成。支持国内外科研院所、跨国公司布局一批重大科技专项和建设一批重点实验室、工程技术研究中心、企业技术创新中心,争取中国“科技创新2030重大项目”和更多国家级科技创新载体落户。依托国家技术转移西南中心,承建立足西南、辐射全国的天府技术交易市场,支持在蓉高等院所加快落实科技成果使用权、处置权、收益权“三权”改革,深化赋予科研人员职务科技成果所有权试点,探索建立“以赛代评”“以投代评”等科技项目形成机制,鼓励全球科技成果在高新区交易、孵化、产业化。(责任单位科技人才局)

    (十五)升级“盈创动力”科技金融服务

    大力推广“盈创动力”科技金融服务模式,进一步完善以政策性产品为核心的债权融资服务体系,以创业投资基金为核心的股权融资服务体系,以经济证券化为导向的改制上市服务体系,以产业全周期保险为方向的科技保险服务体系,以生物医药健康、安全生产、知识产权等领域为突破口,围绕产业发展特色,探索建立保险超市与境内外保险衔接机制,构建面向中小微企业全生命周期的融资路线图,为企业提供“一站式”“全方位”的融资服务。(责任单位财政金融局)

    (十六)创新土地要素供给

    设置公平合理竞买条件,维护土地市场健康稳定发展,促进土地资源多功能立体开发和复合利用。深化弹性出让和租让结合供地方式,促进土地出让年限与产业生命周期紧密结合,确保工业用地合理流动和产业更新换代。工业园区内,在符合规划、不改变用途的前提下,工业企业经批准利用存量土地新建工业厂房或增加原厂房人数的,对于新增的工业厂房不再增收土地价款。探索XOD模式和XOD+PPP复合新型模式,打通城建投入和土地增值收益之间的正反馈路径,吸引专业城市运营商参与开发建设。支持多家总部企业组成联合体联合竞投、联合建设总部大楼。(责任单位公园城市局,发展规划局)

    (十七)打造特色人才服务

    制定高新区急需紧缺人才和高端人才分类标准,形成精准高效的人才招引、培育、服务机制和住房保障体系。对于企业新引进的本科及以上学历的人才、急需技能人才,按市场租金的75%提供青年公寓、技能人才公寓或产业园区配套住房。每年评选“金熊猫人才奖”“金熊猫成就奖”,对入选国家、省、市的高层次人才,最高给予100万元的奖励。大力弘扬工匠精神,加强“高新工匠”技能人才队伍,人才培养基地和技能大师工作室建设,推行企业新型学徒制,建立职业资格证书、技能等级证书、职业技能认定三位一体的人才评价体系。鼓励社会化引才和柔性引才,对经认定的永利下载app送88引才工作站和永利下载app送88海外人才离岸创新创业基地,给予运营补贴和绩效奖励。对高层次人才和高技能人才落户购房、融资理财、医疗保障等方面开通“绿色通道”,享受精准定制和自选菜单式服务,统筹保障入学。(责任单位科技人才局,党群工作部、社会事业局、公园城市局)

    五、高品质营造城市环境

    (十八)提升对外开放载体功能

    深度融入“一带一路”倡议,以空港新城为战略支点打造高铁交通圈,争取在天府国际机场设立国家开放口岸,在空港新城设立综合保税区、临空经济示范区,争创西部内陆国家自由贸易港,深化自贸区金融改革创新,探索自贸账户开立和QDIE试点政策。加快构建符合国际惯例的涉外商贸服务体系,集聚和培育高能级的全球服务机构,打造具有全球资源配置力和影响力的高端服务业集群。以成都领馆区和中国—欧洲中心为载体,争取更多国家驻蓉领馆、国际机构落户,引导更多国际组织总部、跨国公司总部入驻。以“欧洽会”为平台,加强中欧交流合作、投资促进和外事服务。加快中韩、新川国别合作园区建设,推进商事制度、行业监管、城市规划建设等方面的标准规范和通行规则有效衔接。积极支持企业“走出去”,完善企业境外投资政策咨询和融资服务,支持企业开展跨境产能合作和创新合作。(责任单位国际合作投服局,发展规划局、新经济局、空港新城管委会、财政金融局、经济运行局)

    (十九)打造更加开放公平的市场环境

    基于“负面清单+正面鼓励+竞争中性”的原则对外资政策进行持续优化,负面清单之外的领域全面实行“单一窗口、单一表格”受理,对不涉及实施准入特别管理措施的外商投资企业,设立、变更备案事项自受理之日起1个工作日内办结(属于国家规定的进口设备减免税范围除外)。按照“非禁即入”原则,争取在教育、医疗、文化等领域先行先试,进一步扩大跨境电商、跨境支付等开放试点领域。探索开展跨境人民币业务试点,探索建立中外高科技园区双向投融资机制。对市场准入、产业发展、招商引资、招标投标、政府采购、经营行为规范、资质标准等涉及市场主体经营活动的规范性文件和其它政策措施进行公平竞争审查。推进政府购买服务改革,探索编制政府购买服务清单,严禁以不合理的条件对相关企业参与政府采购实行差别待遇或者歧视待遇。探索推行招标投标规范化电子化,推行“互联网+政府采购”模式。简化企业办理投标和履约担保手续,探索取消政府采购投标保证金,减少企业资金成本和资金占用。完善外资投诉处理和民商事纠纷解决机制,及时回应和解决企业反映的问题,提高民商事纠纷解决的国际化程度。(责任单位国际合作投服局,发展规划局、经济运行局、财政金融局、社会事业局、市场监管局、政法委)

    (二十)高标准建设国际化社区

    推动落实《成都市国际化社区建设规划(20182022年)》,聚焦社区形态优化、服务提升、文化融合、高效治理,加快打造独具特色的国际化社区。完善国际化生活配套,大力推进教育、医疗国际化,构建“15分钟生活服务圈”,积极建设社区外籍人士之家,全方位满足涉外企业办事要求和外籍人士工作、生活需求。发展与国际接轨的医疗保险服务,鼓励适应海外人才需求的商业医疗保险产品,支持具备条件的医院与国内外保险公司合作,加入国际医疗保险直付网络系统。支持市场主体建立第三方国际医疗保险结算平台。强化共建共治,通过公益、环保活动载体,广泛吸引中外居民共同参与国际化社区活动,打造国际化社区品牌。实现全区域双语或者多语标识100%覆盖,符合就读要求的外籍及港澳台籍适龄儿童入学机会100%。(责任单位社会事业局,发展规划局、公园城市局、生态环境城管局)

    (二十一)高水平建设智慧城市

    高水平编制智慧城市建设顶层规划,向社会公布智慧城市建设机会清单,开放应用场景。高标准打造高新区智慧治理中心,推动高新区数字化政府转型,构建以新一代通讯技术驱动的泛在物联网络和标准规范的全域泛在物联设施,加快建设视频云平台、时空云平台和人工智能平台。建立可感知、可学习、可持续的数据治理机制,创新数据要素供给模式,建设“政府+运营商+产业”三位一体的大数据共享赋能平台,向区内企业和个人提供海量数据资源、数据能力和算法服务,推动数据开放和高效应用。(责任单位网络理政办)

    六、高效能推进政府治理

    (二十二)进一步提升政务服务水平

    以深化“互联网+政务服务”为主线,推动政务服务大厅与政务服务平台业务融合,整合信息系统,统筹服务资源,统一服务标准,为市场主体提供渠道多样、简便易用的政务服务。加快区级政务大厅“一窗办理、受审分离”改革,实现南区、西区、东区大厅无差别受理和独立办结。实现审批服务事项“马上办”比率60%以上,“一次办”比率95%以上,“网上办”比率100%,个人事项“就近办”比率100%。区级政务大厅90%以上政务服务事项实现“一窗”分类受理,基层便民服务大厅“一窗办”达90%。推动100个以上审批服务事项实现“智能办”。试点政务服务小时清单制,开展服务事项最小颗粒化梳理,以工作小时为计量单位明确办结时限,分类别编制梯度小时办结事项清单,逐步提高最快办结水平。深化拓展自贸区政务服务大厅功能,面向涉外企业、跨国机构、外籍人士,提供外资、外贸、外经、外汇、外专、外籍等“六外”内容一站式服务。(责任单位网络理政办)

    (二十三)深化“首证通”审批改革

    在深入推进“证照分离”“照后减证”改革的基础上,以全方位为企业开办经营提供便利化服务为目标,进一步完善“首证通”审批模式,综合运用“行业准入提示清单(市场主体资质、经营地址、土地性质等)+数据共享+协同监管”方式,开展“照(证)前辅导”“证照联办”及“证证联办”审批流程优化,实现申请材料、审核结果共享,避免重复提交资料,提高审批效率。2019年将“首证通”改革覆盖行业扩展到道路客运公司开办、道路货运公司开办、网络预约出租汽车公司开办、书店开办、广播电视节目制作经营公司开办、医美机构开办、餐饮店开办等7个行业开办事项。2020年争取再推开一批办理事项。(责任单位网络理政办,市场监管局、生态环境城管局、社会事业局、公园城市局、党群工作部)

    (二十四)促进知识产权创造、保护与运用

    高质量建设国家知识产权新经济示范园区,打通知识产权创造、保护、运用、管理和服务全链条,营造激励创新的公平竞争环境。鼓励知识产权创造,围绕规模以上企业和高新技术企业开展专利清零行动,建立高价值专利库。加强知识产权保护,加快建设中国(四川)知识产权保护中心,在新一代信息技术产业等领域开展快速协同保护工作,将发明专利、实用新型和外观设计专利的审查周期压缩一半以上。健全知识产权类案件快审机制,力争实现知识产权案件平均审理周期缩短15天,整体效率再提升15%。建立实施知识产权保护临时行政禁令,继续深化知识产权案件“双报制”,探索建立知识产权刑事案件技术调查官制度。创新知识产权管理,建立专利、商标、版权“三管合一”的综合管理机制,民事、刑事、行政“三检合一”的综合检察机制和“三审合一”的综合司法机制。增强知识产权运用,大力推进知识产权质押融资,拓宽科技型企业的融资渠道。(责任单位科技人才局,检察院、法院、财政金融局、市场监管局)

    (二十五)完善中小投资者保护机制

    联合司法部门、投资者保护协会、行业协会、律师事务所,探索建立中小投资者综合保护机制。加强对中小微企业法律援助、维权援助,引进专业的投资者保护机构,积极提供法律支持,发布典型案例、开展法律知识宣讲活动。探索在管辖权异议处理、证据取证、确立示范案件、全程全方位调解、引入专业支持、降低诉讼成本等程序性环节中,为中小投资人建立便捷、高效的绿色诉讼通道,及时化解矛盾,切实保护中小投资者的合法权益。(责任单位政法委,法院、检察院)

    (二十六)构建以信用为基础的新型监管机制

    建设完善高新区社会信用信息共享平台,强化企业信用信息公示和共享,探索建立与公用事业、公共服务机构、行业协会、社会征信机构涉企信用信息的共享机制,扩大企业信用信息归集范围。构建以信用为基础的新型监管机制,逐步完善企业信用公开、信息查询、基于信用的多部门联合奖惩、企业信用评价等功能。探索企业信用信息大数据分析,推行企业信用画像,实施企业信用分类监管。加快推进“双随机、一公开”监管与信用水平相结合,根据信用水平高低采取差异化的监管措施。大力推进信用数据开放,与符合信息安全和隐私保护要求的金融机构、信用服务机构充分合作,强化信用信息和信用产品应用。深入推进信用信息在政务服务领域的应用,探索打造“诚信通”政务服务品牌。(责任单位市场监管局,发展规划局、网络理政办)

    (二十七)完善包容审慎监管和规范执法

    推行包容审慎监管,对新经济、新业态、新模式实施“三张清单”制度,依法编制从轻处罚事项清单、减轻处罚事项清单和不予处罚事项清单。从行政处罚与违法行为的事实、性质、情节以及社会危害程度相当的原则出发,对首次、轻微的违规经营行为,依法免于行政处罚。严格规范涉企行政执法行为,分类制定实施行政裁量权基准制度,规范裁量范围、种类、幅度,并通过门户网站等向社会公开。坚决依法查处滥用行政权力干涉企业正常经营的行为。全面落实行政复议登记立案制度,拓宽行政复议受理渠道,依法维护企业正当权益。(责任单位生态环境城管局,市场监管局、政法委)

    (二十八)探索构建业界共治模式

    探索构建由政府、企业、市场、专家等多方参与、共同治理的“业界共治”模式,鼓励企业牵头组建高新区产业联盟、行业协会等社会团体,逐步扩大“业界共治”领域。继续做强大数据和网络安全、网络视听与数字文创、5G与人工智能、孵化载体等业界共治理事会,每年设立5000万元业界共治专项资金,每一个理事会最高匹配1000万元的业界共治发展基金,支持企业集群发展。健全和完善商会、行业协会、企业等政府服务对象参与涉企政策文件制定的具体操作办法,通过构建多方参与、共同治理的产业发展新模式,促进市场主体从被管理、被服务转变为自我管理、自我服务,将政府与市场的关系从单向管理转变为共建共治。探索建立民主党派、无党派、新社会阶层人士参与营商环境建设工作机制。(责任单位新经济局,科技人才局、党群工作部)

    (二十九)构建亲清新型政商关系

    出台构建新型政商关系行为清单,鼓励全区干部在依规依纪依法的前提下,大胆开展工作,同企业家正常接触、阳光交往,积极作为、靠前服务、排忧解难,大力弘扬不叫不到、随叫随到、服务周到的“三到精神”,解决企业服务“最后一公里”和工作作风问题。围绕重大建设项目全过程,加强廉政风险防控,推行重大建设项目“廉政双合同”制度,构建实施重大建设项目纪检监察一体化廉政保障服务机制。提升企业守法经营意识,大力培育“遵守法律即安全,按章就能办成事”和“办事不求人,办成事不找人”的政商关系和营商文化。加强政务诚信建设,建立因政府规划调整、政策变化造成企业合法权益受损的依法依规补偿机制。(责任单位经济运行局,纪工委、发展规划局)

    Action Plan of Chengdu Hi-tech Industrial Development Zone on Improving the Business Environment[1]

    2019-2020

    This Action Plan is developed according to the actual conditions of Chengdu Hi-tech Industrial Development Zone (hereinafter “we”) to implement the decisions and plans of the CPC Central Committee, the People’s Government of Sichuan Province and the People’s Government of Chengdu City on improving the business environment, and to speed up the building of a first-class business environment that is international, market-oriented, law-based and convenient.

    I. Guiding Principle

    We will be guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, follow the guiding principles of the 19th National Congress of the CPC and of the serial important instructions given by General Secretary Xi Jinping on the work in Chengdu and Sichuan across the board, adhere to the fundamental requirement of high-quality development, adhere to the five principles of international standards, fair market, convenience and efficiency, legal protection and reform & innovation, establish and improve the whole-life-cycle services system for enterprises, projects and industries, create a better enterprise service, a better industrial ecology, a better urban quality and a better governmental governance, continue to improve the business environment evaluation results and the satisfaction of enterprises with the business environment, and provide strategic support to building a globally-influential zone where the new economy is born and brisk and speeding up the building of a national demonstration zone for high-quality development and a world-class hi-tech park.

    II. Working Objectives

    By the end of 2019, the areas of weakness will have been bolstered across the board, the whole-life-cycle services system for enterprises, projects and industries will have taken initial shape, the business environment of each sector will feature greater facilitation and enterprise satisfaction, and the business environment indicators rank among the best among the country’s hi-tech zones. By the end of 2020, a digital government providing intelligent services will have been put in place on a whole, a better enterprise service, a better industrial ecology, a better urban quality and a better governmental governance will be generally recognized by people, such innovative brands as “First Permit Application Connect” and “Heaven for Entrepreneurship · Jingronghui” will become more eye-catching, and the business environment indicators set a role model for the hi-tech zones across China.

    III. Provision of High-standard Services for Enterprises 

    1. Issuing of business licenses within eight working hours

    We will streamline the enterprise establishment procedures and explore the feasibility of issuing business license, tax invoice and official seal at the same time so as to reduce the enterprise establishment to one process only. And the time for enterprises to apply for their business licenses will be shortened to eight working hours. We will deepen the practices of enterprise establishment application over a unified platform, across the whole area and at multiple sites, gradually allow the intelligent self-service filing of enterprise establishment to run around the clock, and enable all the enterprise registrations to be handled via the self-service terminal, the mobile phone and the computer, and at the street offices, industrial functional zones and banking outlets. We will explore the possibility of providing a set of official seals to local newly-established enterprises for free by means of government purchase to gradually reduce the enterprise establishment cost to zero. We will simplify the business scope registration of enterprises, explore a list management approach to enterprise domiciles or their business premises, and demand no certificate on use of such domiciles from enterprises when they register such domiciles or premises in the list. We will expand the application of e-business licenses, and allow enterprises to download them freely where necessary. We will try the commitment approach to the “subject qualification certificate” of foreign investors, i.e. registering after Hong Kong, Macau and Taiwan investors, as well as foreign investors make an commitment on the authenticity of the certificate duplicates submitted for notarization.     2. Completion of engineering construction project review and approval within 80 working days

    The review and approval system of engineering construction projects will be subject to whole-process, across-the-board reforms. Project land planning permit, engineering construction permit, construction permit and completion acceptance will be granted with one agency playing a leading role and approval in parallel, which will be completed within a specified time limit. The time for administrative license, intermediary service and municipal public service involved in the process from project initiation to project acceptance will be controlled within 80 working days, of which the administrative approval time of different departments will be controlled within 35 working days, and the intermediary services such as construction drawing review and the municipal public services including water, electricity, gas and communication line installation be controlled within 45 working days. The approval time limit will be set depending on project type. The commitment approach will be taken for all the enterprise investment projects to promote the management model of “making commitment first and then performing approval”. We will explore the possibility of canceling construction drawing review or review fee and reducing the institutional transaction cost of enterprises. We will optimize the parallel acceptance mechanism for engineering construction projects, and adopt multi-test integrationand joint acceptance. We will fully launch the regional assessmentreform, and prepare regional assessment reports on a uniform basis, allowing the assessment results to be shared and used within the Zone. We will explore the classified supervision model of projects and also explore the filing of small-scale engineering projects with non-governmental investment and the application for construction permits via a unified platform. We will make it possible to apply for and approve construction permits of construction projects online and to complete the grant of such permits within a specified time limit, and enable the applicants to print the permits by themselves. Furthermore, we will implement the system that designers should be responsible for construction projects as long as the buildings exist, carry out the pilot program that architects should take responsibility for construction projects, and launch the pilot system of buying insurance for construction quality.     3. Overall enhancement of energy use facilitation

    The water, electricity, gas and communication line installation service will be accepted at a single window of the government service hall, and be completed within a specified time limit. The time for the access process will be shortened further. In the areas covered by the municipal water pipe network, the access to water will be done within 15 working days (including the construction time of the commissioned water supply enterprises) or seven working days (excluding the construction time of commissioned third parties). The access to low-voltage power-line communication network will be cut to two steps, non-outdoor electric lining engineering will be completed no more than two working days, and outdoor electric lining engineering will be completed no more than seven working days; the access to high-voltage power-line will be cut to four steps, and ordinary 10KV users will get access to power supply no more than 21 working days. The gas access of collective resident users will be reduced to four steps, and the handling time to no more than eight working days; the gas access of non-resident users will be reduced to three steps, and the total handling time to 6-15 working days. The communication line access will be reduced to three steps, and the total handling time to no more than 13 working days. Approvals of micro and small enterprise users’ access by project planning, road administration, traffic police, greening and other competent authorities will be subject to informed commitment management on a pilot basis. We will implement the government-enterprise consultation mechanism for major construction projects to further reduce access time, fee and energy use cost. Any change to the water, electricity and gas prices will be made public one month in advance to ensure the price adjustment information is open and transparent. We will further improve the energy use stability and processing efficiency under various types of emergencies, reduce non-systematic outages, and shorten the downtime.     4. Across-the-board optimization of real estate registration

    The handling time of general registration of real estate will be reduced to four working days, i.e. three working days for first-time registration of land and one working day for collateral registration. Cancellation registration, sequestration registration and dispute registration will be done without delay. We will build a multi-level and multi-dimensional online office hall of real estate registration, and set up an “online (mobile) registration center” of real estate to realize the around-the-clock inquiry of real estate registration information and handling of part of business. We will actively facilitate the real-time mutual access and sharing of real estate registration information, electronic files and house transaction information, push forward the connectivity of land ownership registration with the data in the systems of cadastral, map and surveying & mapping departments, and explore the linked handling of real estate registration with its related business, e.g. water, electricity, gas, network and cable TV ownership transfer. Additionally, we will actively promote the electronic license service for real estate registration. (Responsible Agencies: Park City Construction Bureau, E-Service Office)

    5. All-round improvement of tax service

    We will promote such intelligent tax measures as online declaration and online real-name collection, reduce the tax-related documents of taxpayers by more than one quarter, enable more than 80% of tax matters to be completed at one time, and endeavor to shorten the tax payment time to 120 hours. We will expand the use of tax payment via chinapay.com, and promote online application & claim, certification and agency issuance of invoices. We will act upon the government’s tax and fee reduction policies across the board, and carry out such measures as additional tax cut over enterprises’ R&D expenses. We will decrease relevant taxes to the lowest statutory tax rates as long as it complies with the government’s tax policies and we are authorized to do so. We will improve such services as making reservation for tax matters, electronic tax rebate, electronic tax payment and pre-check of cancellation of tax registration. We will expand the use of the mobile platform “Tax-Enterprise Mobile Internet” and make our tax services more precise, intelligent and integrated by bundling mobile Internet and artificial intelligence.     6. Increase of facilitation for cross-border trade

    We will build a large transportation, large logistics, and large customs clearance system that seamlessly connects aviation and railway ports. We will introduce such innovative, characteristic enterprise services as customized service, regular communication, 24h customs clearance and whole-process guidance. We will deepen the construction of “smart customs”, carry out reform measures such as customs declaration after entering into a special area, customs declaration after leaving a special area, early declaration, self-declaration & self-payment, transfer between special supervision areas of customs, dispatch in batch but centralized declaration, and shorten the external operation time of goods clearance by over 60% to improve the efficiency of goods clearance and reduce the logistics cost of enterprises. We will launch the whole-process online handling of businesses like export tax rebate declaration, certificate application, approval and tax return across the board, put electronic tax return wholly online, exercise paperless declaration management for Type 1 and Type 2 export enterprises, and realize completion for Type 1 enterprises within four working days and that for Type 2 enterprises within seven working days. We will fully promote the tariff guarantee insurance business, allow tax payment after customs clearance and shorten the customs clearance time; there will be no need for enterprises to pay the deposit, and the insurance fee will be lower than the bank guarantee fee, thus effectively reducing the customs clearance cost and alleviating the financial pressure of enterprises; the insurance application time will be shorter than the bank guarantee, featuring simpler procedure and more convenient handling; the insurance policy will be accepted across the country. We will exempt export VAT and exercise tax of cross-border e-commerce operators without asking them to present the valid vouchers of purchase, launch paperless declaration of export tax rebate and promote export tax rebate in electronic form.     7. Handling of matters in connection with preferential policies at one window

    We will open a special window for handling matters in connection with enterprise-related preferential policies at the Zone-level government service hall, timely sort out and publish the list of enterprise-related preferential policies, set up policy classification, release, inquiry and acceptance mechanisms on the basis of matters, and gradually allow the acceptance of matters in connection with corporate preferential policies at one site, one-stop handling of them at one window and inquiry of them online. We will increase the knowledge of enterprises about related preferential policies and provide them with more access to such policies.     8. Smart and efficient litigation services

    We will comprehensively promote the governance of the source of litigation, adhere to the principle of loose access and strict supervision, and strictly examine the contractual effectiveness of various transaction models and transaction structure innovations. We will conduct online filing and cross-jurisdiction filing of commercial cases involving sale contract disputes, loan contract disputes, financial borrowing contract disputes, outsourcing contract disputes, and entrusted contract disputes in the first instances, and promote the new model of “smart litigation services” which link through a number of business online with electronic litigation services at the core. We will further deepen the “case distribution, mediation, trial and judgment” mechanism reform and effectively distribute cases in consideration of their complexity, importance and urgency. We will actively take measures to shorten the operation time of appraisal and evaluation, and improve the follow-up mechanism for cases subject to appraisal and evaluation. The appraisal and evaluation will be controlled within seven working days from the receipt of application, approval, notification to the parties and determination of the appraisal organization by lottery, to the issuance of the power of attorney. We will strengthen the administrative trial work, and put in place the “three mechanisms”, i.e. the normalization of the government-court communication meetings, the judicial white papers on administrative litigations, and the appearance of the administrative heads in court. We will establish a professional international commercial case trial organization in the Pilot Free Trade Zone. We will strictly control the trial period of cases, shortening the average trial days by five, and increasing the closing rate of civil and commercial cases to 100% within the limited period of time. We will deepen the execution of case judgment decisions and put them into effect immediately, help the winning enterprises to recover debt and the winning market to realize its interests at a faster speed, and effectively enhance the quality and efficiency of adjudication and enforcement.     9. Hearing of bankruptcy cases by using the simplified procedure

    We will strive to create the first local court in the province to hear bankruptcy cases by using the simplified procedure, strengthen the trial of bankruptcy cases, shorten the time for filing and examining bankruptcy cases, and adopt the distribution model of bankruptcy cases in view of their complexity, i.e. fast trial of easy cases on the front office and careful trial of difficult cases on the back office. We will explore a classified bankruptcy treatment model of enterprises, promote the improvement of bankruptcy reorganization and reconciliation system, and help valuable distressed enterprises to pull through their dilemmas. We will improve the restructuring credit of bankrupt enterprises, and enterprises can apply for adding the restructuring information in the financial credit information basic database after restructuring. We will reduce bankruptcy costs, increase bankruptcy recovery rate, and preferably use online auctions for property disposal of debtors in bankruptcy proceedings. We will improve the bankruptcy administrator system, and guide non-intermediaries with engineering technology, scientific knowledge, and enterprise management experience to participate in management, and establish a coordination and communication mechanism with the Association of Bankruptcy Administrators.     10. Wider application of simplified company de-registration

    We will apply simplified de-registration to a wider group, including limited liability companies, non-public stock-limited companies, non-listed companies and specialized cooperatives of farmers, as well as their branches that have not carried out any business activities after obtaining the business license, have not incurred creditor’s rights and debts before applying for de-registration, or have settled their creditor’s rights and debts. The announcement will be published on the national enterprise credit information disclosure system, and the announcement time be shortened from 45 to 20 days. For enterprises in Chengdu Hi-tech Free Trade Zone that have never handled tax-related matters or have handled tax-related matters but have never received invoices, or defaulted on tax payment or fined, the time of their announcement on de-registration will be shortened to less than seven days. All types of enterprises applying for simplified de-registration will no longer submit such documents as liquidation report, investor resolution, tax settlement certificate and certificate on filing of the liquidation group. We will establish a fault-tolerant & error-correction mechanism for simplified de-registration of enterprises. After review by the registration authority, enterprises under the following circumstances that disqualify them for simplification of de-registration will be allowed to apply for simplification again through the prescribed procedures: being put onto the list of enterprises with abnormal business operations, shares being frozen/pledged or movable property being mortgaged, the unincorporated branch of the enterprise not applying for de-registration, etc. For an enterprise that does not complete the letter of commitment in standard language or form, the registration authority can only accept its application for simplified de-registration after the enterprise has made corrections. In case that an enterprise breaks its commitment or makes false commitment, the registration authority will cancel its de-registration in accordance with law.     IV. Supply of High-quality Elements for Industries

    11. Building an industrial ecosphere with global competitive advantages

    Following the concept that “industry is the core, function is the key, park gives support and mechanism provides safeguards”, we will strengthen the specialized production and diversified living functions of those functional areas, and facilitate the shift of parks from assuming a single production function to undertaking a variety of functions, e.g. production, service and consumption.

    With a focus on the key processes of the industrial chain and the high-end  processes of the value chain, we will build an industrial ecosphere with global competitive advantages that features clear themes, accessible elements, resource sharing, collaborative synergy and green recycling. Based on the core, key technologies of “chips, new displays, intelligent terminals and Internet”, we will cultivate and introduce an international-class open laboratory of electronic information industry, bring in R&D center, testing center and technology transfer center, build a sharing platform and exhibition center, and create a new industrial community and talent training base. Based on the biomedical industry system, we will build a full-chain innovative service platform for drug R&D, safety evaluation, and clinical evaluation, and build an insurance linkage mechanism for domestic and overseas biomedical & health sectors, providing a specialized insurance limit of not less than RMB10 billion. With the building of the industrial ecology for new economy in mind, we will speed up the construction of a new generation of new infrastructure, create an information port for the Belt and Road Initiative and major infrastructure as the national Internet exchange center, kick off the approval of new economy like artificial intelligence, the Internet of Things and unmanned driving within the pilot zones of new economy and the construction of test bases, promote the development and commercial application of 5G in intelligent manufacturing, intelligent networked vehicles, environmental monitoring and other fields.     12. Cultivation of enterprises in echelon

    Towards boosting the growth of enterprises, we will compile a “list of opportunities” for local development and make it public on a regular basis to offer more opportunities for the development of all types of enterprises and channel the elements of innovation into the sectors of new economy and onto the tracks of new industries concerning what is needed by a specific project, so that high-quality enterprises can grow to our “urban partners” and private enterprises get more involved in the construction of projects invested by the government. We will cultivate enterprises in echelon based on their development stage, industry leading level, economic density, business growth potential and independent innovation ability, etc. to further stimulate their innovation vitality. Specifically, eagle enterprises in the seed stage will be given a one-off reward of RMB50,000 at initial identification, gazelle enterprises given a one-off reward of RMB100,000-300,000, potential unicorn enterprises and unicorn enterprises given a one-off reward of RMB300,000 or RMB1 million at initial identification, and platform ecology-typed leading enterprises given a one-off reward of RMB2 million at initial identification. We will support start-ups to grow into eagle enterprises by giving them up to RMB500,000 of one-off start-up capital and rent subsidies; we will support the continuous growth of gazelle enterprises by giving those identified to be gazelle enterprises up to RMB5 million as a reward.     13. Development of the service brand for entrepreneurship and innovation - “Heaven for Entrepreneurship · Jingronghui” to a hit

    Leveraging “Heaven for Entrepreneurship · Jingronghui”, China-Europe Center, China-Korea Innovation and Entrepreneurship Park and China Chengdu Returned Students Entrepreneurship Park, we will build an international platform connecting with the world’s top scientific and technological parks and innovative areas, construct a full-chain incubation system across “entrepreneurship nursery, incubator, accelerator and industrial park”, and facilitate the setting of the international standards for “entrepreneurship and innovation” incubation services. We will create an “Internet plus entrepreneurship & innovation service” industry incubation and cultivation network platform, to enable online information release, policy inquiry, declaration and acceptance, incubation carrier information management, enterprise growth evaluation and other functions. We will conduct a comprehensive evaluation of identified incubation platforms each year based on the number of new enterprises, annual sales income of enterprises on such platforms and attraction of equity investment and financing amount, among other dimensions. Top 10 enterprises occupying less than 5,000 square meters will be given a reward up to RMB3 million, and top five enterprises with an area of more than 5,000 square meters will be rewarded RMB5 million at the most.     14. Promotion of the “hi-tech service supermarket”

    We will promote the “hi-tech service supermarket” model, build an online supermarket and several offline supermarkets in the core area and different parks, integrate such hi-tech service formats as R&D design, intellectual property, technology transfer, quality technology service, business incubation, talent service, technology finance and policy consultation, provide enterprises with self-selected convenient and professional services, and promote the transformation of scientific and technological achievements to the mix of various hi-tech service systems across the whole chain of new innovative organizations. We will support Chinese and foreign research institutes and multinational corporations to lay out a number of major science and technology projects and build a number of key laboratories, engineering technology research centers and enterprise technology innovation centers, and strive for attracting China’s “major projects of scientific and technological innovation 2030” and more national scientific and technological innovation carriers. Relying on the National Technology Transfer Southwest Center, we will be responsible for building Sichuan technology trading market in the southwest China which has influence all over the country, support the acceleration of the three rights(right to use, right to dispose and right to earnings) reform of scientific and technological achievements by higher learning institutes in Chengdu, deepen the pilot that scientific researchers shall own the scientific and technological achievements developed by themselves, explore the setup of the scientific and technological project formation mechanisms such as competition in lieu of evaluationand voting in lieu of evaluation, and encourage global scientific and technological achievements to be traded, incubated and industrialized in the Hi-tech Zone.     15. Upgrading of the FinTech services of WINPOWER

    We will make great efforts to promote the FinTech service model of WINPOWER, further improve the debt financing service system with policy products at the core, the equity financing service system with VC funds at the core, the economic securitization-oriented restructuring and listing service system and the scientific and technological insurance service system in the direction of whole-life-cycle insurance of products, explore the establishment of a linkage mechanism between the insurance supermarket and Chinese and foreign insurers in consideration of the characteristics of industrial development, and draw a financing road map throughout the entire life cycle of micro, small and medium-sized enterprises in a bid to render a full package of “one-stop” financing services for enterprises.     16. Innovative supply of land elements

    We will set fair and reasonable bidding conditions, protect the healthy and stable development of the land market, and promote multi-functional and multi-dimensional development and composite utilization of land resources. We will deepen the land supply method of combining flexible transfer and lease, promote the close combination of the land transfer period and the industrial life cycle, and ensure the reasonable flow of industrial land and industrial upgrading. In the industrial park, on the premise of complying with the plan and not changing the purpose, if the industrial enterprises are permitted to use the existing land to build new industrial premises or increase the floors of original factory buildings, the new ones will be no longer subject to any additional land payment. We will explore the X-oriented Development (“XOD”) model and the novel XOD plus Public Private Partnership (“PPP”) model, and open up a positive feedback path between urban construction investment and land value-added income to attract professional city operators to participate in development and construction. We will support a number of headquarter enterprises to form a consortium in jointly bidding for and jointly constructing the headquarter buildings.     17. Provision of characteristic talent services

    We will develop the standards on classification of talents in short supply and high-end talents, and form precise, efficient talent attraction, cultivation and service mechanism and housing guarantee system. The talents with a bachelor or above degree and urgently needed professionals who are newly introduced by enterprises will be provided with youth apartments, skilled talent apartments or supporting houses in industrial parks at 75% of the market rents. We will organize the “Golden Panda Talent Award” and “Golden Panda Achievement Award” selections each year, and give an award up to RMB1 million to the high-level talents selected into the national, provincial and municipal Talent Program. We will vigorously carry forward the spirit of craftsmanship, strengthen the team of skilled persons named “Hi-tech Craftsmen”, talent cultivation base and skilled master studio, promote the new apprenticeship system at enterprises and erect a talent appraisal system integrating professional qualification certificate, skill level certificate and professional skill recognition. We will encourage socialized and flexible talent attraction, and give operational subsidies and performance rewards to the recognized Chengdu Hi-tech Zone talent attraction working stations and Chengdu Hi-tech Zone overseas talent offshore innovation and entrepreneurship bases. We will open a green channelfor high-level talents and skilled talents to settle and buy houses, launch financing and wealth management, and seek for medical insurance, among others, provide them with precise customized and self-selected menu-style services, and ensure their children have school to go.     V. Creating a high-quality urban environment

    18. Improving entrepreneur-friendly platforms for foreign enterprises

    As our contribution to the Belt and Road initiative, we will build a high-speed railway traffic circle, using the Aerotropolis as a strategic stronghold; we will endeavor to establish a national open port at Tianfu International Airport; and set up a comprehensive bonded zone and a model airport economic district, aiming to be the major free trade port for western inland countries. This will further the financial reform and innovation in the free trade zone, while exploring how best to open free trade accounts and carry out the Qualified Domestic Investment Enterprise (QDIE) pilot policy in the free trade zone. We will accelerate the construction of service systems for internationally-oriented businesses in line with international practices, gather and cultivate top-level global service organizations, and build a high-end service industry cluster with global resource allocation and influence. With the Chengdu Consular District and the China-Europe Center as the medium, more countries, international organizations, international organization headquarters and multinational headquarters will be attracted to station here. The EU-China Partenariat will work as a platform for us to strengthen exchanges and cooperation, promote investment and improve foreign services between China and the EU. We will accelerate the construction of China-South Korea and Singapore-Sichuan cooperation parks, and promote the effective integration of the standard rules and regulations of the commercial system, industry supervision, and urban planning and construction. Furthermore, we will actively support enterprises to engage in the international market, improve policy consulting and financing services for corporate overseas investment, and support enterprises to carry out cross-border cooperation with regard to shared production capacity and innovations.     19. Creating a more open and fair market environment

    Based on the principle of “negative list[2] + positive encouragement + unbiased competition”, foreign investment policy will undergo continual improvements, and those fields falling outside the negative list will be fully implemented with the unified approach of “under one roof, using one format”. For foreign-invested enterprises with no Special Administrative Measures for the Access of Foreign Investment1, set-up and registration shall be completed within one working day from the date of acceptance (except for state-stipulated tax exemptions for imported equipment). In accordance with the principle that all unsanctioned goods may enter the market, efforts in the fields of education, medical care, and culture will be prioritized. We shall further expand cross-border e-commerce and international payments, explore a pilot scheme for cross-border RMB business and the establishment of a two-way investment and financing mechanism for Chinese and foreign high-tech parks. We will conduct fair, competitive reviews on market access, industrial development, investment attraction, tendering and bidding, government procurement, normalized business performance, qualification standards and other regulatory documents involving market entities. We will promote the reform and standardization of government procurement of services, preparing a list of approved government procurements. It is strictly forbidden to practice inconsistent or discriminatory treatment towards relevant enterprises' participation in government procurement with unreasonable requirements. We will endeavor to standardize and digitize tendering and bidding, and implement the “Internet + government procurement” model. We will also simplify the procedures for bidding and guarantee their proper use, explore ways to cancel bidding deposits for government procurements, reduce corporate fund costs and fund occupancy costs, and innovate and improve the dispute resolution mechanism to give a quick response to problems put forward and resolve civil and commercial disputes by international standards.     20. High standards for building an international community

    We will promote the implementation of the Chengdu International Community Construction Plan 2018-2020, focusing on the optimization of community form and services, cultural integration, and efficient governance in order to accelerate the creation of a unique international community. We will improve the international living facilities, vigorously promote the internationalization of education and medical care, build a “amenities circle” in which residents can get their basic needs met within 15 minutes, and actively build a home for foreigners in the community. In so doing, we will fully meet the requirements of foreign-related enterprises and the working and living needs of foreigners. We will develop medical insurance services that are in line with international standards; develop commercial medical insurance products that meet the needs of overseas talents; encourage qualified hospitals to cooperate with domestic and foreign insurance companies, joining the direct payment network system of international medical insurance; and support the market to establish a third-party international medical insurance settlement platform. We will strengthen collaborative construction and governance, and attract Chinese and foreign residents to participate in international community activities through public welfare and environmental protection activities to create a model international community. 100% bilingual or multilingual signs across the area will be covered, and 100% of the admission opportunities of school-age children from foreign countries and relevant regions of China like Hong Kong, Macao and Taiwan shall be realized.     21. High-level smart city building

    We will prepare a plan for smart city construction to high standards. A list of smart city building opportunities will be published to the public and open applications will be held.. We will create a smart governance center in the high-tech zone to promote the transformation to a digitalized government to build a universal IOT network and standardized universal IOT facilities driven by next-generation communication technologies; construct a business center and data center; build a video cloud platform, a spatio-temporal cloud platform and an artificial intelligence platform, all to high standards. We will accelerate the establishment of a perceptible, flexible, and sustainable data management mechanism, innovate data factor supply model, build a “government + operator + industry” big data sharing and empowerment platform, provide massive data resources, data capabilities and algorithm services to enterprises and individuals in the region, and promote data openness and efficient application.     VI. Promoting governance with high efficiency

    22. Further improving the level of government services

    Focusing on deepening the "Internet + government service", we will promote the business integration of the government service hall and the government service platform; integrate the information system; coordinate the service resources; and unify the service standards to provide market entities with diverse channels and easy-to-use government services. We will accelerate the government service reform to “accept cases in one service window, separated case acceptance and trial” in the district level, and realize the indiscriminate acceptance and independent completion of the service halls in the southern, western and eastern districts. Over 60% of examination and approval services will be completed “immediately”, over 95% will be finished “once and for all”, 100% of services will be accessible online, and 100% of personal services will be available “nearby”. It will be possible to complete more than 90% of government services at one generalized service counter at the district-level government service halls, and a convenience service hall at the local level will provide up to 90% of its services through one service counter. More than 100 approval services are aimed to be done using smart technology. We will carry out pilot tests of our government service hours listing system and detailed organization of service items, making the time limit for each service item clear, with working hours as a unit of measurement. Finally, we will compile a prioritized list of service tasks, organized by categories, in order to gradually decrease service completion time. We will enhance the function of the government service hall of the Free Trade Zone, and provide one-stop services involving foreign affairs, foreign trade, foreign economics, foreign exchange, foreign experts, and foreign nationality for foreign-related enterprises, multinational organizations, and foreigners.     23. Facilitating the certificate examination and approval reform

    On the basis of furthering the “Separation of Licenses and Certificates” reform, we will aim to comprehensively provide convenience services for enterprise set-up and operations, and further improve the approval model wherein detailed material is only needed for the first certificate. In order to put in place the application materials, the sharing of audit results, the prevention of repeat submissions and a rise in approval efficiency, we will comprehensively apply the method of providing “industry access advice lists (market entity qualifications, business operation address, land status, etc.) + data sharing + collaborative supervision"; we will carry out optimized approval procedures such as counseling sessions before applying for license certificates and the joint issuance of certificates and licenses. In 2019, certificate examination and approval reform has extended to road passenger transportation, road freight, online taxi hailing services, bookstores, broadcasting and TV programs, cosmetic medical institutions, catering stores, etc. In 2020, we will strive to open more business sectors for the convenience of enterprises.     24. Promoting the creation, protection and application of intellectual property rights

    We will construct a high-quality National Intellectual Property New Economy Demonstration Park, opening the entire chain of intellectual property creation, protection, application, management and services, and creating a level playing field with incentives for innovation. We will encourage the creation of intellectual property, carry out patent clearing actions for enterprises above certain scale and high-tech enterprises, and establish high-value patent libraries. It is necessary to strengthen the protection of intellectual property rights,  accelerate the construction of the Intellectual Property Rights Protection Center (Sichuan), carry out rapid collaborative protection work for the new IT industry, and reduce the review period of invention patents, utility models and design patents by more than half. We will improve the rapid review mechanism for intellectual property rights cases and strive to shorten the average trial period of intellectual property rights cases by 15 days, increasing the overall efficiency by 15%. We will establish an interim administrative ban on the implementation of intellectual property rights protection; continue to deepen the "double reporting system" of intellectual property rights cases; and explore the establishment of a technical investigator system for criminal intellectual property rights cases. Intellectual property management will be innovated to establish a “three-in-one” comprehensive management mechanism for patents, trademarks and copyrights; a “three-in-one” comprehensive checking mechanism for civil, criminal and administrative cases; and a “three-trial-in-one” comprehensive judicial mechanism. We will enhance the use of intellectual property rights, vigorously promote intellectual property mortgage financing, and broaden the financing channels for technology-intensive enterprises.     25. Improving the protection mechanisms for small and mid-level investors

    We will work with judicial departments, investor protection associations, industry associations, law firms, etc. to explore the establishment of comprehensive protection mechanisms for small and mid-level investors. In order to strengthen legal aid and legal rights protection for small and medium-sized enterprises, we will introduce professional investor protection institutions, actively providing legal support, publishing typical cases, and holding events to spread legal knowledge. We will establish convenient and efficient green litigation channels for small and mid-level investors, resolve conflicts in a timely manner, and protect the legitimate rights and interests of small and medium investors. This will be achieved by exploring procedural stages such as: processing objections to the jurisdiction, evidence collection, the establishment of model cases, extensive mediation throughout the conflict resolution process, introducing professional support and lowering litigation costs.     26. Building a new credit-based regulatory mechanism

    We will build a sharing platform for social credit information in high-tech zones; strengthen the publicity and sharing of corporate credit information; endeavor to establish a corporate credit information sharing mechanism for public utilities, public service agencies, industry associations, and social credit agencies; and expand the collection scope of corporate credit information. We will build a new credit-based supervision mechanism and gradually improve the function of corporate credit publication, information inquiry, multi-departmental credit-based reward and punishment, and corporate credit evaluation. We will analyze corporate credit information, promote corporate credit profiles, and implement categorized corporate credit supervision. We will accelerate the combination of the “random inspection and publication” supervision method with credit rankings, adopting differentiated regulatory measures according to credit ranking. We will vigorously promote transparency in publishing credit data; fully cooperate with financial institutions and credit service institutions that adhere to information security and privacy protection regulations; and strengthen the application of credit information and credit products. Furthermore, it is also necessary to promote the use of credit information in the field of government services and explore ways to create a government service brand based on credibility.     27. Improving the inclusivity and vigilance of supervision and standardizing law enforcement

    We will implement inclusive and vigilant supervision, including the “three lists” system (“Power List”, “Responsibility List” and “Negative List”) aimed at the new economy, new commercial activities, and new models. In doing so, we will compile a list of cases eligible for lighter penalties, a list of cases eligible for mitigation of punishments, and a list of cases eligible for non-penalty. Based on the principle that administrative punishment shall equal the facts, nature, severity and harm towards society of the illegal act, the first and minor violations of business rules are exempted from administrative punishment according to the law. We will enforce strict standards upon administrative law enforcement for enterprises, classifying the benchmarks for administrative discretion, standardizing the scope, type and range of discretion, and publicizing relevant information to the public through portal websites. We must resolutely investigate and punish abuses of administrative power that interfere with the normal operation of enterprises; fully implement the administrative re-evaluation registration and filing system; broaden the channels for accepting administrative re-evaluations, and safeguard the legitimate rights and interests of enterprises according to the law.     28. Endeavoring to build an industrial co-governance model

    We will endeavor to build an industrial co-governance model involving multiple participants such as governments, enterprises, markets, experts, etc.; encourage enterprises to take the lead in setting up industry alliances, industry associations and other social groups in high-tech zones; and gradually expand the “industrial co-governance” field. We will continue to set up co-governance councils for such industries as data and network security, network audio-visual industries, digital cultural and creative industries, 5G and artificial intelligence, and innovation platforms, and set up 50 million yuan of industrial co-governance special funds each year. Each council has a maximum fund of 10 million yuan to support the development of enterprise clusters. We will improve the specific operational methods for government service recipients such as chambers of commerce, industry associations, and enterprises to participate in the formulation of enterprise-related policies. This will promote the transformation of market entities from being managed and serviced to self-management, by constructing a new model of industrial development involving multi-participation and co-governance. We will explore suitable ways to establish a working mechanism for democratic parties, non-partisan parties, and new social classes to participate in the construction of the business environment.     29. Building a new type of close and honest relationship between politics and commerce

    We will introduce a list of actions for building a new type of close and honest relationship between politics and commerce, and encourage all cadres in the area to work boldly on the premise of compliance with laws and regulations, to engage with entrepreneurs in a normal and healthy way, to act positively, to serve thoughtfully, to solve problems, and to actively promote the spirit of service. Keeping a close eye on the entire process of major construction projects, we will strengthen our efforts to prevent corruption, implement the “double contracts” system for major construction projects, and construct and implement an integrated, clean and honest service mechanism guaranteeing the disciplined inspection and supervision of major construction projects. We will enhance the awareness of enterprises on legal abidance, and actively cultivate clean political-commercial relationships and a business culture of "observing the law and doing things according to the rules" and "having things done without the help of the authorities". We will strengthen the construction of government integrity, and establish a legal compensation mechanism for enterprises whose legitimate rights and interests are damaged due to government planning adjustments and policy changes.     VII. Safeguarding Measures

    30. Improving the work mechanism

    We will establish a leadership working mechanism in which the leading group takes the lead and have general control, with the management committee of the Party Working Committee in charge of specific matters, and each department performs its duties thus. We will improve the work record, issue record, and record of work highlights in order to construct a better business environment, and make clear the work promotion time and deadlines. We will establish a target assessment mechanism, and conduct follow-up monitoring to combat behavior that causes damage to the business environment (Responsible Agency: Party Committee Office and Government Office, Discipline Committee, E-Service Office)

    31. Eliminating all obstacles in the communication channels between government and enterprises

    We will eliminate all existing obstacles in the communication channels between government and enterprises; establish a system wherein leading cadres regularly take on people’s opinions; and innovate new mechanisms for entrepreneurs to participate in the development of policies related to enterprises. We will improve the appeal management mechanism; rely on the network governance platform and the government service window to quickly understand and solve the problems encountered in the production and operation of market entities; and safeguard the legitimate rights and interests of various market entities.     32. Strengthening policy publicity and image promotion

    We will strengthen publicity, create an atmosphere of good public opinion, and enhance enterprises’ sense of gain and satisfaction. We will give full play to the guidance of positive role models; promptly promote the experience and results gained in various functional departments; carry out case selection of business environment optimization and promote model cases, so as to comprehensively enhance the influence and attractiveness of the high-tech zones.
